Terms and Conditions for the use of the PAHO Toolkit site

The use of this PAHO Website constitutes acceptance of the following Terms and Conditions, in the case where there may be discrepancies between the text of these Terms and Conditions in English and in Spanish the document in Spanish will prevail.

PAHO reserves the right to take legal action to stop any violation or breach of these Terms and Conditions.

PAHO can modify these Terms and Conditions at its complete discretion and will publish these modifications in the current site. Using this PAHO site after these changes have gone into effect constitutes the user’s acceptance of the new Terms and Conditions.

PAHO reserves the exclusive right to cancel the Access of any user due to a violation or breach of these Terms and Conditions.

Use of PAHO’s name

The PAHO name, acronym and/or logo, as well as its trademarks are protected by international law. Except for the purpose of providing author attribution, these cannot be used without prior written authorization from PAHO. The name, acronym, logo and/or trademarks cannot be used with promotional purposes or in any way that indicates, suggests or can be interpreted as an association, affiliation, sponsorship or endorsement by PAHO.

Limitation of Liability

The documents and information published or provided through this site are provided without any guarantee, explicit or implicit. PAHO does not provide any type of warranty and will not be held responsible for the exactness or truthfulness of the information or the documents presented herein. PAHO can periodically modify the documents and information contained in this site without prior warning. Under no circumstance will the Organization be liable for any losses, damages and/or injuries that may presumably arise from the use of this site or the information or documents contained herein. Users must use this site at their own risk. In no case will PAHO be liable for damages even when they may have been warned against.

PAHO reserves the right to modify or discontinue any document or information that it makes available to the public through this site, with or without prior warning.

The use of country or territory designations should not be considered as indicative of PAHO’s position regarding the legal status of any country or territory, its authorities and institutions, or the recognition of any boarders.

PAHO will not be responsible for any damage or loss that may arise from or relate to the use or failure of the site or the information or documents contained herein, including in cases arising from improper, improper or fraudulent use. Privileges and Immunities

Nothing contained in this Terms and Conditions shall be deemed a waiver, express or implied, of any immunity from suit, judicial process, confiscation, taxation, or other immunity or privilege which PAHO may enjoy, whether pursuant to treaty, convention, law, order or decree of an international or national character or otherwise, or in accordance with international customary law.

Claims for possible breaches

PAHO will make an effort to impede any illicit activities or any activities that contradict these Terms and Conditions. However, if you believe that any information contained on the site or its materials may be infringing your rights or the rights of third parties, including, without limitation, intellectual property rights, you should contact PAHO by submitting a detailed description of the alleged violation to the following address: pahotoolkit@paho.org

Resolution of Disputes

The settlement of any dispute, controversy or claim arising out of, or relating to the use of this site or its materials shall be resolved amicably. Unless any such dispute, controversy or claim between the parties arising out of or relating to the use of this site or breach, termination or invalidity of this terms and conditions is settled amicably within sixty (60) days after receipt by one Party of the other party’s request for such amicable settlement, such dispute, controversy or claim shall be referred by either party to arbitration in accordance with the UNCITRAL Arbitration Rules then obtaining. The arbitral tribunal shall have no authority to award punitive damages. Any arbitration award rendered as a result of such arbitration shall be considered to be the final adjudication of any such controversy, claim or dispute and shall bind the Parties.

If the user does not agree with any of the terms and conditions contained herein they should abstain from using the site and any material it contains.
